By accessing the Website, submitting a booking inquiry, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access the Website or use the Services.

IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER IN SECTION 13, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.

We do not guarantee arrival times, as delays may occur due to traffic, weather, or other factors beyond our control. We do not guarantee the accuracy, completeness, or timeliness of any information on the Website.

3. Bookings and Payments

• Bookings: All bookings are subject to confirmation by us. We may cancel or modify bookings at our sole discretion, including due to vehicle availability, weather, road conditions, or other unforeseen circumstances.
• Payments: You agree to pay all fees associated with the Services in advance or as specified at booking. Payments are non-refundable except as explicitly stated in our cancellation policy below. You authorize us to charge your provided payment method. We may use third-party payment processors, and you agree to their terms.
• Cancellations and Refunds: Cancellations must be made at least 48 hours in advance of the scheduled pickup time for a full refund, minus any processing fees. Cancellations made less than 48 hours in advance, no-shows, or late arrivals are non-refundable. We are not liable for any indirect costs or losses arising from cancellations, including missed flights or events.

4. User Conduct and Passenger Responsibilities

You agree not to:

• Use the Services for any illegal or unauthorized purpose.
• Engage in abusive, harassing, discriminatory, or disruptive behavior toward our chauffeurs, staff, or other passengers.
• Damage or soil vehicles (additional cleaning or repair fees may apply).
• Consume alcohol if under the legal age, or possess/use illegal substances.
• Smoke or vape in vehicles.
• Exceed vehicle passenger or luggage capacity.

Violation of these rules may result in immediate termination of Services, refusal of future bookings, and potential legal action. You are responsible for all actions of passengers in your booking.

5. Intellectual Property

All content on the Website, including text, graphics, logos, and software, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

6. Privacy

Your use of the Website and Services is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Services, you consent to our collection and use of your data as described therein.

7. Disclaimers

WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM VEHICLE ACCIDENTS, DELAYS, LOSS OF PROPERTY, PERSONAL INJURY, OR MISSED CONNECTIONS, EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW. YOU ASSUME ALL RISKS ASSOCIATED WITH USING THE SERVICES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CHAUFFEURS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS, THE WEBSITE, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, chauffeurs, and suppliers from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Website or Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any actions by passengers in your booking.

10. Force Majeure

We shall not be liable for any failure to perform due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, traffic, weather, or road closures.

11. Governing Law

These Terms shall be governed by the laws of the State of Ohio, without regard to conflict of laws principles.

12. Dispute Resolution

Any dispute arising from these Terms, the Website, or the Services shall be resolved through binding arbitration administered by the American Arbitration Association in Cincinnati, Ohio, under its rules. Arbitration shall be conducted by a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction.

YOU AND WE AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

You agree to submit to the exclusive jurisdiction of the courts located in Hamilton County, Ohio, for any actions not subject to arbitration.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Website and Services, superseding any prior agreements.
